Apple announced its highly-anticipated iPad device yesterday to largely mixed reviews. While much remains to be seen about the device, we at DigitalWorkflowCLE are most interested how it—and similar devices such as the HP Slate—will change lawyering. The prospect of making an oral argument from a slate device or examining a witness without a paper outline is intriguing. Slate Tablets Coming for Paperless Lawyers

Many are calling this year’s Consumer Electronics Show “the Slate Show,” given that many manufactures are introducing new slate tablets. For example, the QUE by Plastic Logic, is a thin, light and versatile e-book reader that will be publicly released in the spring. Apple, HP and most other leading electronics manufacturers are set to release similar products as well. Because these devices can be used not just for following the news, but also for reading briefs, correspondence and legal research, they hold great promise for making paperless lawyering easier. As a result, we expect to follow them closely here at DigitalWorkflowCLE.

AZ Ethics Opinion Approves Online Storage of Client Files

The Arizona State Bar Association has issued an advisory ethics opinion approving of lawyers’ use of encrypted online storage services to store client information. See Az. State Bar Op. 09-04 (Dec. 2009). The opinion, however, warns lawyers to keep informed of technological developments:

Lawyers providing an online file storage and retrieval system for client access of documents must take reasonable precautions to protect the security and confidentiality of client documents and information. Lawyers should be aware of limitations in their competence regarding online security measures and take appropriate actions to ensure that a competent review of the proposed security measures is conducted. As technology advances over time, a periodic review of the reasonability of security precautions may be necessary.

On-Line CLE: Paperless 102–Working with PDFs, CaseMap and Mindmanager

We have posted a new on-line CLE video, Paperless 102: Working with PDFs, CaseMap and Mindmanager. This video continues the discussion from Paperless 101 regarding the digital management of documents and information in the practice of law. The program has been preapproved for one (1) hour of Louisiana MCLE credit (including law office practice).

The CLE video covers the following topics:

working with Portable Document Format files (PDFs), including viewing PDFs, creating PDF files, bookmarking, commenting, using the Typewriter tool, Bates stamping, redaction, and using digital signatures;
using Lexis/Nexis CaseMap to organize facts and documents, and using various CaseMap features (including displaying fields, filtering records and working with linked files); and,
using mindmapping and MindManager to organize facts for arguments, depositions and witness examinations.
